Individualizare sanctiuni - noi circumstante atenuante

Plenul Consiliului Concurentei a adoptat astazi modificarile la instructiunile privind individualizarea sanctiunilor prevazute de art. 51 din Legea concurentei nr.21/1996.
Pe langa ajustarile impuse de Legea 149/2011, subliniem aparitia a 2 noi circumstante atenuante:
1) existenta unui program de conformare cu regulile de concurenta (competition compliance) cu conditia sa poate fi demonstrata implementarea sa efectiva - reducere de pana la 10% din nivelul de baza.
2) reducerea nivelului de baza cu pana la 25% in cazurile in care cifra de afaceri a unei intreprinderi pe piata sau pe pietele relevante afectate de incalcare reprezinta cel mult 20% din totalul cifrei de afaceri.
In plus, in materie procedurala, in ceea ce priveste recunoasterea, va apare un model de astfel de recunoastere (care sa fie clara, completa, neechivoca) dar se va prevedea si existenta unor discutii la sediul Consiliului prin care partile la investigatie sa poata agrea forma finala a recunoasterii lor.

Competition Compliance - news in the European Union and in Romania


There are a few interesting novelties with regard to competition compliance programs.
First, on 23 November 2011 the European Commission released its guidelines on competition compliance - ”Competition Matters” -http://ec.europa.eu/competition/antitrust/compliance/index_en.html.
The brochure signals that the European Commission is keen to promote compliance within the business community. No reduction of the fine or other incentive is provided for the undertakings that do have in place competition compliance programs which shows that sanctioning of the infringements remains the most important compliance tool in the policy applied by the Commission.
Secondly, just as a happy coincidence, the revised guidelines for the fining in case of breach of the antitrust law, finalized this week by the Romanian Competition Council include, as a new mitigating factor, the existence of an effective competition compliance program. The guidelines will be approved next week and are expected to come into force before the end of the year.
RCC is contemplating the introduction of such a mitigating factor since 2010 and there were some serious arguments against it such as: the fact that companies are always obliged to pay maximum respect to the legal rules, including those on competition and the fact that the very existence of the infringement may be evidence that the competition compliance program was not effective.
In the end, we decided to go forward with the aim to send a signal to the Romanian undertakings that they should do more on prevention as long as the Romanian Competition Council is also committed to apply sanctions to detected and proved infringements at a level which will ensure an adequate deterrence.

The competition principle is still strong and alive in EU Law


Many commentators asked, since the Lisbon Treaty, if there is a ”competition fatigue” in the European Union and why this principle looked to have been downgraded to a protocol which is an annex to the Treaty on the European Union. This question seems to have received an answer from the ECJ, one of the main promoters of undistorted competition within EU over the years.

In the end, the ”downgrading” looks as being rather en expression of political compromise which is the basis for the evolution of the EU law and institutions (for the good and the bad it brings).

Moldova - noua lege a concurentei si - premiera - lege ajutor de stat

La Chisinau, Agentia Nationala de Protectia Concurentei incearca sa convinga Parlamentul sa adopte o noua lege a concurentei, moderna, si, in premiera pentru Moldova, o lege privind ajutorul de stat.

Primul blog de concurenta din Romania

Acesta este primul blog romanesc dedicat dreptului concurentei si politicilor de concurenta.
Blogul doreste sa reprezinte o ”fereastra” deschisa catre temele specifice dreptului concurentei, teme importante pentru oricine desfasoara o activitate economica sau este doar interesat de mersul lucrurilor in mediul economic.
Sunt multe de spus, multe de explicat, multe de inteles.
Acest blog este un experiment - deocamdata.
